Paul Rose speaks at the 8th GLA Arbitration and Litigation Summit, Malaysia 2026

Paul Rose, member of ArbDB Chambers, was invited to be a speaker on the first day of the conference on 22nd January 2026 in Session 3, entitled Arbitration 4.0 Reinventing Institutional Arbitration.


The panel comprised of Moderator Ms Sharifah Thaherah, Head of Legal and Regulatory, APAC & India, Infobip, Malaysia, Datuk Joy Wilson Appukattan, a barrister at KH Limm & Co, Malaysia and Heather Yee Jing Wah, the Registrar of the AIAC in Malaysia.


Paul’s subject matter comprised of two topics, namely global attitudes to confidentiality and interference with arbitral integrity.


Paul spoke for about 17 minutes on global attitudes to confidentiality, pointing out that there were a number of jurisdictions where confidentiality does not exist in arbitration proceedings and highlighted that as a general rule, absence of confidentiality applied where public monies are involved. Otherwise, civil law jurisdictions apply confidentiality alongside common law jurisdictions, with the above exception.


On the question of arbitration 4.0 and the previous session which concerned the use of artificial intelligence, it was clear that feelings about artificial intelligence were mixed and that AI was unlikely to replace the use of arbitral discretion, notwithstanding rapid changes in technology, a subject explored in depth by Lord David Neuberger in his lecture to the Worshipful Company of Arbitrators in 2024.


In respect of interference in arbitral integrity, Paul questioned whether arbitral institutions acting as appointing bodies could interfere with the exercise of arbitral integrity to the extent of expecting a particular result benefitting one party and gave an example.
